Return and Withdrawal Policy
RETURN AND WITHDRAWAL POLICY
GENERAL PRINCIPLE AND THE STATUS OF THE PARTIES
The Bulkoon platform (“Platform”) is a B2B (Business to Business) platform that connects business suppliers (“Seller”) with business customers (“Buyer”). All parties (seller and buyer) hold the status of "merchant" under the Turkish Commercial Code (TCC), and the transactions conducted are of a "commercial nature." In this context, the "right of withdrawal without cause" (14-day return right) regulated in the Law No. 6502 on the Protection of Consumers is not valid for transactions made through this platform. Every member purchasing a product is deemed to have accepted the conditions in this statement in advance.
RETURN CONDITIONS, DEFECT NOTIFICATION AND EXCLUDED PRODUCTS
2.1. All transactions conducted through the Platform are commercial sales in accordance with the Turkish Commercial Code No. 6102 (“TCC”). In this context, the Buyer acknowledges and declares that they do not have the right of withdrawal without cause as regulated in the Law No. 6502 on the Protection of Consumers; returns can only be made in the limited cases specified in this article and through a defect notification in accordance with TCC Art. 23.
2.2. Return requests will only be considered under the following conditions, provided that the original packaging of the product is intact and retains its resalable nature:
Defective Product: The product is broken, damaged, or incomplete at the time of delivery or does not possess the qualities promised in the product description.
Incorrect Product: A product that is qualitatively or quantitatively different from the Buyer’s order has been sent by the Seller.
2.3. The Buyer is obliged to notify the Platform or in writing of any defects that may be subject to return; in cases where the defects are clearly apparent at the time of delivery within 2 (two) days, and in cases of hidden defects that arise from inspection after delivery within 8 (eight) days, specifying the product/service and the reason for return. It is mutually agreed that these periods are of a forfeiting nature, and if exceeded, the product will be deemed accepted in its current state.
2.4. The return of the following types of products is not possible unless the product is defective:
Custom Production/Modification: Products that are specially produced, prepared, or modified according to the Buyer’s commercial needs.
Hygiene and Health: Products whose packaging has been opened and are not suitable for return for health or hygiene reasons.
Non-returnable by Nature: Disposable products, goods at risk of expiration, or those likely to spoil quickly.
2.5. In return transactions based on just cause, shipping costs are borne by the Seller. All additional costs arising from the Buyer’s failure to notify within the time frame or incorrect return shipments will be covered by the Buyer.
RETURN PROCEDURE AND FINANCIAL PROVISIONS
3.1. Cash Refunds: For approved returns, the return process will be initiated within 15 business days from the time the product reaches the Seller and is inspected. Operational costs (bank commission, shipping, courier, etc.) will be deducted from the refund amount.
3.2. Foreign Currency: The refund will be processed based on the Turkish Lira (TRY) amount collected at the time of purchase; claims for exchange rate differences are not accepted.
3.3. Credit Card and Installments: Bank commissions deducted during credit card transactions and promotional points cannot be refunded.
REJECTION OF RETURN REQUEST AND WITHDRAWAL
4.1. Return requests will be rejected in the following cases:
The product is damaged due to the Buyer’s fault (usage error, etc.) after delivery.
The return procedure is initiated without approval or with incomplete documents.
The Buyer has made multiple return requests that constitute abuse within the last 1 (one) year.
4.2. The Buyer has the right to withdraw from their request until the return is completed.
DISPUTES AND COMPETENT COURT
Turkish Law will apply to disputes arising from this policy, and the Istanbul (Çağlayan) Courts and Enforcement Offices are competent.
POLICY CHANGES AND EFFECTIVENESS
6.1. Bulkoon reserves the right to unilaterally change this Return and Withdrawal Policy at any time in accordance with commercial strategies, changes in legal regulations, or operational needs.
6.2. Changes will take effect on the date they are published on the platform. Significant changes may be notified to users at their registered email addresses or announced through the panel.
6.3. Users' continued use of the platform or placing orders after the publication of changes means they accept the updated policy.
6.4. Policy changes are generally valid for orders placed after the date the change takes effect, while previous transactions will continue to be subject to the old provisions within the framework of acquired rights.
