Third Party Data Transfer Commitment

COMMITMENT REGARDING THE PROTECTION OF PERSONAL DATA

This Commitment Regarding the Protection of Personal Data (“Commitment”) contains the commitments of the supplier (“Company”) who is a real or legal person member of the Bulkoon platform and operates through the platform, to BULKOON AYAKKABI VE DERİ ÜRÜNLERİ SANAYİ TİCARET LİMİTED ŞİRKETİ, registered with the Trade Registry under number 1130643, located at Akçaburgaz Mah. 3027. Sk. No: 1 F Esenyurt / Istanbul (“Company”) (individually “Party” and collectively “Parties”) regarding the personal data transferred by the Company to the Company under the Supplier Agreement.

  1. Within the scope of this Commitment;

    1. “Personal Data(s)”;

      Any information relating to an identified or identifiable natural person that will be transferred by the Company to the Company,

    2. “Special Qualified Personal Data(s)”; Data related to a person's race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, clothing and attire, membership in associations, companies or trade unions, health, sexual life, criminal conviction and security measures, as well as biometric and genetic data (the term “Personal Data(s)” in this Commitment will also include “Special Qualified Personal Data(s)” where appropriate),

    3. “Processing”; Any operation performed on personal data, whether or not by automated means, including collection, recording, storage, preservation, alteration, rearrangement, disclosure, transfer, acquisition, making available, classification, or prevention of use,

    4. “Law”; refers to the Law on the Protection of Personal Data No. 6698.

  1. The Company accepts, declares, and commits that it processes the Personal Data to be transferred to the Company in accordance with the procedures and principles set forth in the Law, relevant regulatory actions, and provisions regarding the protection of Personal Data in the relevant legislation.

  2. The Company accepts, declares, and commits that it has informed the owners of the Personal Data to be transferred to the Company in accordance with the procedures and principles set forth in the Law, relevant regulatory actions, and provisions regarding the protection of Personal Data in the relevant legislation, and has obtained the explicit consent of the data owners where required by the conditions.

  3. The Company accepts, declares, and commits to take all necessary technical and administrative measures to ensure that the transfer of Personal Data to the Company is carried out in compliance with the law, taking into account the decisions of the Personal Data Protection Board.

  4. If the personal data to be transferred to the Company by the Company is special qualified data, the Company accepts, declares, and commits that it will transfer such Personal Data to the Company in accordance with Article 6 of the Law, relevant legislative provisions, and decisions of the Personal Data Protection Board, subject to additional security measures and authorizations.

  5. The Company accepts, declares, and commits that it will immediately (within a maximum of three business days) forward any data owner requests related to the Company, which are communicated to it directly or indirectly, and will act in accordance with the Law in this regard.

  6. The Company reserves the right to recourse against the Company for any direct or indirect damages incurred by the Company due to the Company's violation of this Commitment or applicable legislation, or due to reasons arising from the Company, the Company's business partners, or third parties to whom personal data is sent by the Company. The Company accepts, declares, and commits that in such cases, if requested by the Company, it will immediately pay all direct and indirect damages incurred by the Company in cash and in full, along with all accessories.

  7. This Commitment is subject to Turkish law. All disputes arising from or related to this Commitment will be resolved through final arbitration in accordance with the Istanbul Arbitration Center Arbitration Rules.
