Third-Party Data Transfer Commitment

COMMITMENT REGARDING THE PROTECTION OF PERSONAL DATA

This Commitment Regarding the Protection of Personal Data (“Commitment”) contains the undertakings of the real or legal person supplier (“Company”) who is a member of the Bulkoon platform and operates through the platform, towards BULKOON AYAKKABI VE DERİ ÜRÜNLERİ SANAYİ TİCARET LİMİTED ŞİRKETİ, registered with Trade Registry number 1130643, located at Akçaburgaz Mah. 3027. Sk. No: 1 F Esenyurt / Istanbul (“Company”) (individually “Party” and collectively “Parties”) within the scope of the Supplier Agreement executed between them, regarding the personal data transferred by the Company to the Company.

  1. Within the scope of this Commitment;

    1. “Personal Data(s)”;

      Any information relating to an identified or identifiable natural person to be transferred by the Company to the Company,

    2. “Special Categories of Personal Data”; Data relating to a person’s race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, clothing and appearance, association, company or union membership, health, sexual life, criminal convictions and security measures, as well as biometric and genetic data (within this Commitment, the term “Personal Data(s)” shall also include “Special Categories of Personal Data” to the extent appropriate),

    3. “Processing”; Any operation performed on personal data such as obtaining, recording, storing, preserving, altering, reorganizing, disclosing, transferring, acquiring, making accessible, classifying, or preventing the use of data, either fully or partially by automated means or by non-automated means as part of any data recording system,

    4. “Law”; Means the Personal Data Protection Law No. 6698.

  1. The Company acknowledges, declares, and undertakes that it processes and transfers the Personal Data to the Company in accordance with the procedures and principles set forth in the Law, relevant regulatory decisions, and provisions on the protection of Personal Data in applicable legislation.

  2. The Company acknowledges, declares, and undertakes that it has informed the data subjects of the Personal Data transferred to the Company in accordance with the procedures and principles set forth in the Law, relevant regulatory decisions, and provisions on the protection of Personal Data in applicable legislation, and has obtained explicit consent from data subjects where required.

  3. The Company acknowledges, declares, and undertakes that it will take all necessary technical and administrative measures, considering the decisions of the Personal Data Protection Board, to ensure that the transfer of Personal Data to the Company is carried out lawfully.

  4. If the personal data to be transferred by the Company to the Company is special category data, the Company acknowledges, declares, and undertakes that it will transfer such Personal Data to the Company subject to additional security measures and authorizations in accordance with Article 6 of the Law, relevant legislation, and decisions of the Personal Data Protection Board.

  5. The Company acknowledges, declares, and undertakes that it will immediately (no later than three business days) forward any data subject requests related to the Company received directly or indirectly to the Company and will act in compliance with the Law in this regard.

  6. The Company acknowledges that the Company reserves the right of recourse against the Company for any direct or indirect damages, legal, administrative, and criminal sanctions, and compensations that the Company may incur due to the Company’s breach of this Commitment or applicable legislation, or due to reasons arising from the Company, the Company’s business partners, or third parties to whom the Company has sent personal data. The Company undertakes to immediately, fully, and in cash compensate the Company for all direct and indirect damages, including all accessories, upon the Company’s request for these reasons.

  7. This Commitment is governed by Turkish law. All disputes arising from or related to this Commitment shall be finally resolved by arbitration under the Istanbul Arbitration Center Arbitration Rules.
